Welcome to Sol Au Pairs.
By accessing or using our website, submitting an enquiry, completing a registration form, booking a call, purchasing a product, downloading our materials, signing an agreement, communicating with us, or using our services, you agree to these Terms and Conditions.
Please read these Terms carefully before using our services.
1. Who We Are
Sol Au Pairs is an Australian-based au pair agency that provides introduction, matching, placement support, mediation, resources, templates, digital products, and guidance for au pairs and host families in Australia.
Sol Au Pairs acts as an introduction, matching, and support agency only.
Sol Au Pairs does not employ au pairs or host families, does not act as a recruitment agency for employment purposes, and does not supervise the day-to-day living arrangement between an au pair and a host family.
The au pair and host family remain responsible for their own decisions, conduct, communication, legal obligations, safety obligations, and compliance with any agreement entered into between them.
2. Definitions
In these Terms:
“Au Pair” means a person introduced, screened, supported, or placed by Sol Au Pairs for the purpose of a cultural exchange arrangement with a Host Family.
“Host Family” means any individual, family, household, parent, guardian, or representative using Sol Au Pairs’ services to seek, host, communicate with, or enter into an arrangement with an Au Pair.
“Placement” means the cultural exchange arrangement between an Au Pair and Host Family, whether confirmed verbally, in writing, by email, through a signed agreement, through payment of fees, or through the commencement of the arrangement.
“Services” means any introduction, matching, screening, support, mediation, resources, digital products, consultation, placement assistance, rematch support, replacement support, or related services provided by Sol Au Pairs.
“Agreement” means any written agreement, digital agreement, signed contract, confirmation email, accepted terms, invoice, or agreed placement document between Sol Au Pairs, the Host Family, and/or the Au Pair.
3. Relationship Between These Terms and Signed Agreements
These Terms apply to all use of Sol Au Pairs’ website, services, digital products, resources, placement support, and communications.
Where a Host Family or Au Pair enters into a separate written agreement with Sol Au Pairs, or with each other, that signed agreement will also apply.
If there is any inconsistency between these Terms and a signed agreement, the signed agreement will apply to the extent of that inconsistency.
Nothing in these Terms is intended to exclude, restrict, or modify any rights, remedies, guarantees, or protections that cannot be excluded under Australian Consumer Law or any other applicable law.
4. Eligibility
Our services are intended for individuals aged 18 years and over.
By using our website or services, you confirm that you are at least 18 years old and legally able to participate in an au pair arrangement.
You also confirm that all information you provide to Sol Au Pairs is accurate, complete, honest, and up to date.
Sol Au Pairs reserves the right to refuse, pause, or stop services if false, misleading, incomplete, or concerning information is provided.
5. Authority to Act for the Household
Where one parent, guardian, or household representative registers with Sol Au Pairs, signs an agreement, confirms a placement, or communicates placement instructions, they confirm that they have authority to act on behalf of the Host Family and household.
The Host Family is responsible for ensuring that all parents, guardians, adult household members, and relevant carers are aware of and agree to the placement terms, expectations, household responsibilities, and any agreements entered into with Sol Au Pairs or the Au Pair.
6. Services Provided by Sol Au Pairs
Sol Au Pairs may provide:
Introduction and matching services between Au Pairs and Host Families.
Reasonable candidate screening.
Interviews with Au Pair candidates.
Reference checks where applicable.
Collection of relevant documents.
Access to resources, guides, templates, and support materials.
Ongoing support during placements.
Check-ins and mediation where appropriate.
Replacement or rematch support where applicable and subject to these Terms or the relevant signed agreement.
Sol Au Pairs takes reasonable steps to screen candidates and support suitable matches. However, Sol Au Pairs relies on information provided by Au Pairs, Host Families, referees, government bodies, and third parties.
Sol Au Pairs cannot guarantee the accuracy, completeness, continued validity, future conduct, compatibility, performance, reliability, driving ability, childcare ability, or suitability of any Au Pair or Host Family.
The final decision to proceed with a placement rests with the Host Family and Au Pair.
7. Candidate Availability and Match Confirmation
Sol Au Pairs may introduce Au Pair candidates who appear suitable and available at the time of introduction. However, candidate availability can change.
Sol Au Pairs is not responsible if an Au Pair withdraws, changes plans, accepts another placement, experiences visa or travel delays, becomes unavailable, or decides not to proceed.
A match is not confirmed until both the Host Family and Au Pair have agreed to proceed, any required fees have been paid, and any required agreements or confirmation steps have been completed.
Any proposed arrival date is an estimate unless confirmed in writing by all parties.
Sol Au Pairs is not responsible for travel delays, flight cancellations, visa delays, illness, border issues, family emergencies, candidate withdrawal, Host Family withdrawal, or other circumstances affecting an Au Pair’s arrival.
Host Families should not make non-refundable arrangements based solely on an estimated arrival date.
8. Changes to Placement Details
Placement details, including start dates, end dates, duties, hours, pocket money, location, travel plans, car use, and household needs, may change during the matching or placement process.
Any material changes should be discussed clearly and confirmed in writing between the relevant parties.
Sol Au Pairs is not responsible for changes made directly between an Au Pair and Host Family unless Sol Au Pairs has expressly agreed to those changes in writing.
9. Fees and Payment Terms
All Host Family matching, placement, consultation, and support services are subject to fees as outlined on our website, Fees page, invoice, proposal, or signed agreement.
Fees may include, but are not limited to:
Registration fees.
Placement fees.
Consultation fees.
Replacement placement fees.
Mediation fees.
Digital product fees.
Other agreed service fees.
Unless otherwise agreed in writing:
Registration fees are non-refundable once registration has commenced.
Placement fees are payable once a match is confirmed.
All fees must be paid in full before the Au Pair’s arrival.
Payments are non-transferable.
Fees are subject to change at any time, but fee changes will not affect services already confirmed in writing.
Fees paid to Sol Au Pairs are for introduction, matching, administration, screening, placement support, resources, and related services.
Nothing in this section limits any non-excludable rights a customer may have under Australian Consumer Law.
10. Late Payments, Chargebacks and Debt Recovery
All invoices must be paid by the due date stated on the invoice.
If fees remain unpaid, Sol Au Pairs may pause or refuse services, withhold introductions, delay confirmation of a placement, or terminate services.
If a customer disputes or reverses a payment without first attempting to resolve the matter directly with Sol Au Pairs, Sol Au Pairs may suspend services while the dispute is investigated.
Where a chargeback, payment reversal, or payment dispute is found to be incorrect or not reasonably justified, the customer remains responsible for the original amount owing, together with any reasonable fees, charges, administrative costs, debt collection costs, legal costs, or payment processing fees incurred by Sol Au Pairs, to the extent permitted by law.
11. Non-Circumvention and Introduction Fee Protection
Any Au Pair introduced to a Host Family by Sol Au Pairs remains an introduction made by Sol Au Pairs.
If a Host Family proceeds with an Au Pair introduced by Sol Au Pairs, whether directly or indirectly, during or after the matching process, the applicable placement fee remains payable.
Host Families must not use Sol Au Pairs’ introductions, candidate profiles, contact details, interviews, communications, or information to arrange a private placement outside Sol Au Pairs in order to avoid fees.
This applies whether the placement is confirmed immediately or at a later date, unless otherwise agreed in writing by Sol Au Pairs.
12. Digital Products and Resources
Any digital products, downloadable resources, contracts, templates, guides, checklists, forms, or support materials provided by Sol Au Pairs are for personal use only.
They may not be copied, shared publicly, redistributed, resold, modified for resale, or used for commercial purposes without written permission from Sol Au Pairs.
Sol Au Pairs does not guarantee any specific outcome, placement success, dispute resolution result, legal compliance, or financial result from the use of digital products or resources.
Our resources are general in nature and should not be relied upon as legal, migration, tax, accounting, employment, medical, or insurance advice.
13. Au Pair and Host Family Responsibilities
Host Families and Au Pairs are responsible for their own conduct, communication, decisions, and compliance with relevant laws.
Host Families are responsible for providing fair, safe, and respectful living conditions, including:
A clean, safe, and private bedroom.
Meals and reasonable access to household facilities.
Agreed weekly pocket money.
A fair weekly schedule.
Reasonable rest time and days off.
Duties that align with the agreed placement.
A safe home environment.
Appropriate insurance where relevant.
Respectful communication and support.
Au Pairs are responsible for:
Holding and maintaining a valid visa.
Maintaining appropriate health, travel, accident, and/or liability insurance.
Providing accurate personal information.
Communicating honestly and respectfully.
Following agreed household rules and placement expectations.
Complying with visa conditions and relevant laws.
Obtaining or maintaining any required Working With Children Check, police check, or equivalent clearance where required by law or requested by the Host Family or Sol Au Pairs.
Both parties are expected to follow the Sol Au Pairs Code of Conduct and raise concerns early, respectfully, and honestly.
14. Safety and Child Protection
Sol Au Pairs takes child safety and placement safety seriously.
If Sol Au Pairs becomes aware of a serious safety concern, child protection concern, allegation of abuse, unsafe conduct, serious misconduct, dishonesty, or behaviour that may place a child, Au Pair, Host Family, household member, or another person at risk, Sol Au Pairs may take any reasonable action it considers appropriate.
This may include pausing or terminating services, notifying relevant parties, recommending that a placement ends, declining further support, withholding introductions, or reporting concerns to relevant authorities where required or appropriate.
Sol Au Pairs is not responsible for investigating criminal matters, legal claims, child protection matters, or safety incidents beyond the scope of its role as an introduction and support agency.
15. Screening and Candidate Information
Au Pairs placed through Sol Au Pairs may undergo a screening process, which may include:
A personal interview with Sol Au Pairs.
Childcare experience review.
Reference checks.
Collection of identification.
Visa information.
Police check or equivalent clearance.
Working With Children Check where applicable.
First Aid or CPR certificates where applicable.
Driving licence details where relevant.
Other supporting documents where applicable.
Sol Au Pairs takes reasonable steps to screen candidates, but we rely on information provided by Au Pairs, Host Families, referees, government bodies, and third parties.
Sol Au Pairs does not guarantee that any information provided is complete, accurate, current, or free from error.
Sol Au Pairs does not guarantee the future behaviour, suitability, compatibility, childcare performance, driving ability, reliability, or conduct of any Au Pair or Host Family.
Host Families are strongly encouraged to conduct their own interview, ask detailed questions, request further information if needed, discuss household expectations clearly, and satisfy themselves that the match is suitable before confirming a placement.
16. Visa, Legal, Tax and Migration Disclaimer
Sol Au Pairs is not a registered migration agent and does not provide migration advice.
Sol Au Pairs does not provide legal, tax, accounting, employment, insurance, medical, or financial advice.
Any information provided about visas, Working Holiday visas, Work and Holiday visas, 88-day work, tax, insurance, driving, checks, or legal obligations is general information only.
Au Pairs are solely responsible for applying for, obtaining, and maintaining a valid visa and complying with all visa conditions.
Host Families and Au Pairs should seek advice from the Department of Home Affairs, a registered migration agent, lawyer, accountant, insurer, medical professional, or relevant authority where required.
Sol Au Pairs is not responsible for visa refusals, visa delays, visa breaches, border issues, changes in visa conditions, or incorrect visa assumptions made by an Au Pair or Host Family.
17. Insurance, Health and Driving
Au Pairs must organise and maintain appropriate health, travel, accident, and/or liability insurance for the duration of their stay.
Host Families are responsible for ensuring their home environment is safe and that they hold appropriate household, vehicle, and other relevant insurance.
If an Au Pair is required or permitted to drive a family vehicle, the Host Family is responsible for ensuring the vehicle is properly insured, including compulsory third party insurance and comprehensive vehicle cover.
The Host Family must ensure the Au Pair is approved, listed, or otherwise covered to drive under the relevant insurance policy before the Au Pair drives the vehicle.
Specific arrangements regarding vehicle use, petrol, tolls, traffic infringements, insurance excess, long-distance driving, personal use, and geographic limits must be agreed clearly between the Host Family and Au Pair.
Sol Au Pairs is not responsible for accidents, fines, infringements, insurance disputes, damage, injury, loss, or costs arising from vehicle use.
18. Mediation and Support
Sol Au Pairs may provide support and mediation where reasonable and appropriate.
Host Families and Au Pairs are encouraged to first discuss concerns openly, respectfully, and directly with each other.
Where issues cannot be resolved directly, Sol Au Pairs may assist with mediation.
Where included in the relevant agreement, the first three mediation sessions may be provided at no cost. Further mediation may be charged at AUD $85 per session or as otherwise advised by Sol Au Pairs.
Sol Au Pairs may decline, pause, or end mediation where:
A party refuses to communicate reasonably.
A party acts aggressively, abusively, dishonestly, or inappropriately.
A party breaches these Terms, a signed agreement, or the Code of Conduct.
The issue is outside the scope of Sol Au Pairs’ services.
Sol Au Pairs reasonably believes continued mediation is not appropriate.
Mediation does not guarantee that a placement will continue or that a dispute will be resolved.
19. Refunds, Credits and Replacement Support for Host Families
Sol Au Pairs offers a limited replacement guarantee to Host Families where an Au Pair proves unsuitable for the placement through no fault of the Host Family.
Unless otherwise agreed in writing, the replacement guarantee applies only where:
The placement ends within twenty-one (21) days of the placement start date;
The issue relates to the Au Pair’s conduct, performance, or significant unforeseen compatibility issue;
The Host Family has complied with all obligations under these Terms, the Sol Au Pairs & Host Family Agreement, the Au Pair & Host Family Agreement, and the Sol Au Pairs Code of Conduct;
The Host Family has raised concerns promptly and allowed reasonable opportunity for communication or mediation where appropriate; and
Sol Au Pairs determines that a replacement is appropriate.
The replacement guarantee is limited to one replacement placement only.
Once one replacement placement has been offered or provided, no further free replacement, refund, credit, extension, or additional placement support will be owed unless expressly agreed in writing by Sol Au Pairs.
Any replacement placement is subject to candidate availability, timing, location, suitability, visa conditions, the Host Family’s requirements, and Sol Au Pairs’ usual placement process.
A refund, credit, free replacement, or extension is not available where the placement breakdown is caused or contributed to by the Host Family, including but not limited to:
The Host Family changing their mind after confirming a placement.
Failure to pay agreed pocket money.
Requiring excessive hours.
Requiring duties beyond the agreed terms.
Failure to provide agreed accommodation, meals, living conditions, or support.
Breach of these Terms, a signed agreement, or the Sol Au Pairs Code of Conduct.
Failure to communicate reasonably with the Au Pair or Sol Au Pairs.
Unsafe, unsuitable, or unfair placement conditions.
Repeated personality conflicts or compatibility issues, particularly where similar concerns have occurred with previous Au Pairs.
The Host Family contributing to the breakdown of the placement.
Visa issues, travel disruption, illness, family circumstances, or other matters outside Sol Au Pairs’ control.
Nothing in this section limits any non-excludable rights a customer may have under Australian Consumer Law.
20. Replacement Placements
Where a replacement placement is provided following the early end of a previous placement, that replacement placement does not restart, renew, or extend any original replacement guarantee, refund period, credit period, or free replacement entitlement.
If a replacement placement ends early, Sol Au Pairs is not required to provide a further free replacement, refund, credit, or extension unless expressly agreed in writing.
Sol Au Pairs may, at its discretion, offer further assistance or a new placement option, which may be subject to an additional fee.
21. Rematch Support for Au Pairs
If a placement ends early, Sol Au Pairs may assist the Au Pair in looking for a new Host Family where appropriate.
Any new placement will depend on family availability, timing, location, visa conditions, suitability, the Au Pair’s preferences, and the Au Pair continuing to meet Sol Au Pairs’ placement requirements.
Sol Au Pairs will make reasonable efforts to provide support and guidance during the transition. However, a new Host Family placement cannot be guaranteed.
Sol Au Pairs is not responsible for accommodation costs, travel costs, loss of income, visa issues, emotional distress, or other costs incurred by an Au Pair where a placement ends early.
22. Compatibility and Early Departure
Sol Au Pairs aims to create thoughtful, suitable matches, but compatibility cannot be guaranteed.
Cultural differences, personality differences, homesickness, changing family needs, communication issues, illness, travel disruption, visa matters, and unexpected circumstances may affect a placement.
Sol Au Pairs is not liable for early departures, placement breakdowns, personality differences, cultural misunderstandings, communication issues, or changes in circumstances.
Any costs related to a placement ending early, including flights, accommodation, temporary childcare, loss of income, transport, or other expenses, are the responsibility of the relevant Host Family or Au Pair, unless otherwise agreed in writing or required by law.
23. Limitation of Liability
To the fullest extent permitted by law, Sol Au Pairs is not liable for any loss, damage, injury, illness, death, claim, dispute, expense, or cost arising from or connected with:
The actions, omissions, conduct, or decisions of any Au Pair, Host Family, child, household member, guest, or third party.
The day-to-day living arrangement between an Au Pair and Host Family.
Childcare, household duties, supervision, transport, driving, outings, travel, or activities during a placement.
Property damage, theft, personal injury, illness, accident, or emergency.
Early departure, placement breakdown, incompatibility, or communication issues.
Visa refusal, visa delay, visa breach, travel disruption, border restrictions, or changes in personal circumstances.
Loss of income, replacement childcare costs, accommodation costs, travel costs, emotional distress, or perceived loss of value.
Statements, promises, assumptions, or representations made by an Au Pair or Host Family during interviews, introductions, matching, or placement discussions.
Any decision made by a Host Family or Au Pair to proceed with, continue, change, or end a placement.
Where Sol Au Pairs’ liability cannot be excluded by law, Sol Au Pairs’ liability is limited, to the extent permitted by law, to the re-supply of the relevant service or the amount paid directly to Sol Au Pairs for that service.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under Australian Consumer Law.
24. Indemnity
The Host Family agrees to indemnify and hold harmless Sol Au Pairs, its directors, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, losses, costs, or expenses, including legal fees, arising from or connected with:
The Host Family’s breach of these Terms, any signed agreement, or the Sol Au Pairs Code of Conduct.
The Host Family’s conduct, omissions, household conditions, or instructions.
The Host Family’s failure to provide safe, fair, or agreed placement conditions.
The Host Family’s failure to comply with legal, tax, insurance, visa-related, safety, or household obligations.
Any claim made by an Au Pair, child, family member, guest, neighbour, or third party arising from or connected with the placement.
This indemnity applies except to the extent the claim is caused by Sol Au Pairs’ own proven negligence, fraud, or wilful misconduct.
25. Privacy and Data Collection
By submitting forms, signing up, booking services, purchasing products, signing agreements, or communicating with Sol Au Pairs, you agree that we may collect, store, use, and disclose your information in accordance with our Privacy Policy.
We may use third-party platforms and business systems to manage information, including but not limited to Tally, Google Workspace, Airtable, MailerLite, payment providers, e-signature platforms, website platforms, and other secure business tools.
Sol Au Pairs may retain records related to enquiries, registrations, services, placements, payments, communications, and agreements for up to seven (7) years, or as otherwise required or permitted by law.
26. Consent to Share Placement Information
By using Sol Au Pairs’ services, Host Families and Au Pairs consent to Sol Au Pairs sharing relevant personal information where reasonably necessary for registration, screening, matching, placement, support, mediation, safety, administration, legal compliance, or related services.
This may include profiles, photos, contact details, references, documents, interview notes, availability, location preferences, placement requirements, visa-related information, driving information, childcare experience, and other placement-related details.
Sol Au Pairs will only share information that is reasonably relevant to the placement process, support process, or safety of the placement.
27. Confidentiality and Candidate Profiles
Au Pair profiles, Host Family profiles, contact details, references, interview notes, documents, photos, placement details, and private communications shared by Sol Au Pairs are confidential.
They are provided only for the purpose of considering, arranging, supporting, or managing an au pair placement.
They must not be copied, published, forwarded, uploaded online, shared with third parties, used for private recruitment, or used for any purpose outside the Sol Au Pairs placement process without written permission.
Host Families and Au Pairs must not misuse, publish, distribute, or disclose private, personal, sensitive, or confidential information about each other, Sol Au Pairs, children, household members, or placement matters without consent, unless required by law.
28. Social Media, Photos and Public Sharing
Host Families and Au Pairs must not publish, share, or post photos, videos, private messages, personal information, children’s images, household details, addresses, documents, disputes, or placement-related information publicly without the consent of the relevant person.
Photos or videos of children must not be shared publicly without the express consent of the Host Family.
Sol Au Pairs may only use photos, testimonials, or placement stories for marketing where appropriate consent has been provided.
29. Complaints and Concerns
Any concerns about Sol Au Pairs’ services should be raised in writing as soon as possible.
Sol Au Pairs will take reasonable steps to review and respond to complaints in a fair and timely manner.
Host Families and Au Pairs are expected to provide accurate information, relevant context, and reasonable cooperation during any complaint, mediation, or review process.
Sol Au Pairs may request written summaries, supporting documents, screenshots, schedules, agreements, or other relevant information in order to properly understand and respond to a concern.
Raising a complaint does not automatically entitle a person to a refund, replacement, rematch, credit, or extension unless required by law or expressly agreed in writing by Sol Au Pairs.
30. Intellectual Property
All content, branding, logos, website material, guides, templates, documents, digital products, forms, checklists, resources, and written materials are owned by Sol Au Pairs unless otherwise stated.
They may not be copied, reproduced, modified, redistributed, resold, uploaded, shared publicly, or used commercially without written permission from Sol Au Pairs.
Unauthorised use of Sol Au Pairs’ intellectual property may result in termination of services and further action where appropriate.
31. Testimonials, Reviews and Feedback
Sol Au Pairs may publish testimonials, reviews, messages, or feedback submitted by users.
By submitting a review, testimonial, message, or feedback, you give Sol Au Pairs permission to display it publicly using your first name, general location, or other details you have agreed to provide.
You may request removal at any time by contacting Sol Au Pairs.
Sol Au Pairs may edit testimonials for length, clarity, spelling, or privacy, provided the meaning is not materially changed.
32. Email and Marketing Consent
By providing your email address or phone number through our website, forms, purchases, downloads, bookings, enquiries, or services, you consent to receive communications from Sol Au Pairs.
These communications may include placement information, service updates, resources, newsletters, marketing, administrative messages, and transactional emails.
You can unsubscribe from marketing emails at any time using the unsubscribe link in our emails.
Sol Au Pairs will take reasonable steps to comply with applicable spam and electronic marketing laws.
Transactional, administrative, safety-related, service-related, or placement-related communications may still be sent where necessary.
33. Third-Party Links and Services
Our website, emails, resources, and documents may include third-party links, affiliate links, government links, booking tools, payment providers, form platforms, or external services.
Sol Au Pairs is not responsible for the content, accuracy, security, policies, availability, or services of third-party websites or platforms.
Use of third-party websites or services is at your own risk and may be subject to separate terms and policies.
34. Force Majeure
Sol Au Pairs is not liable for any delay, cancellation, inability to perform, interruption, or failure to provide services due to events beyond our reasonable control.
This includes, but is not limited to:
Visa delays or visa refusals.
Government restrictions.
Border closures.
Pandemics or public health events.
Natural disasters.
Transport disruption.
Flight cancellations.
Illness.
Family emergencies.
Technology failures.
Platform outages.
Candidate withdrawal.
Host Family withdrawal.
Other unforeseen circumstances beyond Sol Au Pairs’ reasonable control.
35. Refusal, Suspension or Termination of Services
Sol Au Pairs may refuse, suspend, pause, or terminate services at any time where Sol Au Pairs reasonably believes that a person has:
Provided false, misleading, incomplete, or concerning information.
Failed to pay fees or agreed pocket money.
Breached these Terms, a signed agreement, or the Sol Au Pairs Code of Conduct.
Acted abusively, dishonestly, aggressively, unreasonably, or inappropriately.
Created unsafe, unfair, or unsuitable placement conditions.
Failed to communicate reasonably with Sol Au Pairs, the Au Pair, or the Host Family.
Misused Sol Au Pairs documents, resources, intellectual property, or confidential information.
Placed Sol Au Pairs, an Au Pair, a Host Family, a child, or another person at risk.
Used Sol Au Pairs’ services in a way that is unlawful, harmful, or inconsistent with the purpose of the service.
Once a placement is confirmed and the Au Pair has arrived, Sol Au Pairs’ responsibility is limited to reasonable support and mediation, unless otherwise agreed in writing.
This does not override the Host Family’s obligations to the Au Pair under the separate Au Pair & Host Family Agreement.
36. Electronic Communications and Signatures
The parties agree that communications, confirmations, agreements, notices, consents, signatures, and records may be provided electronically, including by email, online form, e-signature platform, text message, or other digital communication.
By using Sol Au Pairs’ services, signing electronically, ticking an acceptance box, replying with written confirmation, or proceeding with a placement, you consent to the use of electronic communications and electronic signatures where permitted by law.
An electronic signature, typed name, checked box, or written confirmation may be relied upon as evidence of acceptance, intention to be bound, or agreement to proceed.
37. Dispute Resolution
If a dispute arises in connection with these Terms, a signed agreement, or Sol Au Pairs’ services, the parties agree to first attempt to resolve the issue in good faith through written communication.
Where appropriate, the parties may participate in mediation or support facilitated by Sol Au Pairs before taking further action.
Nothing in this section prevents Sol Au Pairs from taking urgent action where there is a safety concern, child protection concern, unpaid fee, misuse of confidential information, breach of intellectual property, or other serious matter requiring immediate response.
38. Entire Agreement and Variations
These Terms, together with any signed agreement, invoice, written confirmation, Code of Conduct, Privacy Policy, and agreed placement documents, form the agreement between the relevant parties.
Any variation to these Terms or a signed agreement must be confirmed in writing.
Sol Au Pairs is not bound by verbal statements, informal comments, assumptions, or promises unless confirmed in writing by Sol Au Pairs.
39. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining Terms will continue to apply.
40. Survival
Any clauses relating to fees, unpaid amounts, confidentiality, privacy, intellectual property, limitation of liability, indemnity, refunds, replacements, non-circumvention, dispute resolution, and governing law continue to apply after services end, a placement ends, or an agreement is terminated.
41. Changes to These Terms
Sol Au Pairs may update these Terms from time to time.
The version published on our website at the time of booking, purchase, registration, or use of our services will apply unless otherwise agreed in writing.
Continued use of our website, services, or materials after updated Terms are published means you accept the updated Terms.
42. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the jurisdiction of the courts of New South Wales, Australia.
