Welcome to Sol Au Pairs. By accessing and using our website (www.solaupairs.com.au), booking services, or downloading our materials, you agree to the following Terms and Conditions. Please read them carefully.

1. Who We Are

Sol Au Pairs is an Australian-based agency that connects au pairs with host families. We also offer support tools, digital downloads, and other resources to assist with the placement experience.

2. Eligibility

Our services are intended for individuals aged 18 and over. By using our site or signing up, you confirm you are of legal age and eligible to participate in au pair arrangements under Australian law.

3. Services and Fees

  • All host family and au pair matching services are subject to fees as outlined on our Fees page.

  • Fees are subject to change at any time but will not affect bookings already confirmed.

  • Registration and placement fees are non-refundable once the matchmaking process has begun, unless otherwise agreed in writing.

4. Digital Products (e.g. DIY Pack)

  • Any downloadable resources (contracts, templates, guides) are for personal use only and may not be redistributed or resold.

  • We do not guarantee any specific outcome or success from using our digital materials.

5. Au Pair and Host Family Responsibilities

We act as an intermediary and do not employ au pairs or host families. You acknowledge that:

  • All parties are responsible for complying with Australian visa, tax, and employment laws.

  • It is your responsibility to verify all documents and conduct appropriate interviews or reference checks.

  • We encourage all families and au pairs to follow our Code of Conduct to promote open communication, fairness, and a positive experience for everyone involved.

6. Data Collection and Privacy

By submitting forms or signing up via our website, you agree that we may collect, store, and use your information in accordance with our Privacy Policy. We use secure third-party tools such as Tally, Google Sheets, and MailerLite to manage data.

7. Limitation of Liability

7.1 Friendly Explanation

We’re here to support you throughout your au pair journey and will always do our best to help if any issues arise. However, it’s important to understand that Sol Au Pairs is not responsible for what happens in the home once an au pair placement has been made.

We act as an introduction and matching service only. We do not employ au pairs or host families and cannot supervise their day-to-day actions.

Sol Au Pairs is not liable for:

  • Any injury, illness, harm, or accident that occurs during a placement (including to children, au pairs, or others);

  • Any damage to property, disputes, or early departures;

  • Any decisions or conduct by host families or au pairs after placement.

We’ll always be available to provide guidance, check in with both sides, and offer support if needed — but the responsibility for the living arrangement, care, and safety rests entirely with the host family and au pair.

7.2 Legal Clause

To the fullest extent permitted by law, Sol Au Pairs is not liable for:

  • Injury, illness, damage, loss, or death arising from the actions or inactions of any au pair or host family;

  • Property damage or personal harm that occurs in the host family home;

  • Any disputes, disagreements, or legal matters between au pairs and host families;

  • Loss of income or perceived service value following a change in placement, early departure, or cancellation.

Our total liability is limited to the amount paid directly to Sol Au Pairs for our services.

8. Refunds and Cancellations

Placement fees are non-refundable once the matchmaking process has begun. However, if we’re unable to place a suitable au pair within a reasonable timeframe, we may offer credit toward a future placement at our discretion.

If you are on the 6+ month package and your au pair departs within the first 30 days of the placement start date, we may offer one free replacement au pair, subject to availability and suitability.

Refunds are not offered due to changes in family circumstances, early au pair departures beyond the 30-day window, or visa issues outside our control.

9. Force Majeure

Sol Au Pairs is not liable for any delay or failure to perform its obligations due to events beyond our control, including but not limited to government restrictions, visa suspensions, border closures, pandemics, natural disasters, or other unforeseen circumstances.

10. Intellectual Property

All content, branding, logos, and materials on this site are owned by Sol Au Pairs and may not be copied or used without permission.

11. Testimonials and Reviews

We may publish testimonials or reviews submitted by users. By submitting a review, you give us permission to display it publicly with your first name and location (if provided). You may request removal at any time by contacting us.

12. Email Consent

By providing your email through any of our forms or purchases, you consent to receive occasional updates and resources from Sol Au Pairs. You can unsubscribe at any time using the link in our emails.

13. Third Party Links

We may include affiliate or third-party links on our site. We are not responsible for the content, policies, or services of those third-party sites.

14. Termination

We reserve the right to refuse service or terminate access to anyone for any reason, particularly in cases of misuse, fraud, or breach of these Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in the courts of New South Wales.

16. No Legal or Migration Advice

Sol Au Pairs is not a registered migration agent and does not provide legal or immigration advice. Any general guidance provided on visas (such as the Australian Work and Holiday or Working Holiday visa) is for informational purposes only. For specific legal advice or eligibility, you should contact the Department of Home Affairs or a registered migration agent.

17. Au Pair Screening and Vetting

All au pairs placed through Sol Au Pairs undergo a screening process which includes:

  • A personal interview with our team

  • At least one childcare reference check

  • A valid police check from their country of residence (or Australia, if applicable)

While we do our best to vet every candidate thoroughly, Sol Au Pairs cannot guarantee the ongoing behaviour, compatibility, or performance of an au pair in a family setting.

We encourage all host families to:

  • Conduct their own interview with the au pair

  • Request additional references if desired

  • Clearly discuss house rules, childcare expectations, and safety/emergency procedures directly

The final decision to host an au pair lies with the family.

18. Visa Responsibility (for Au Pairs)

All au pairs are solely responsible for applying for and maintaining a valid visa to enter and stay in Australia. Sol Au Pairs is not responsible for visa outcomes or for ensuring compliance with visa conditions.

19. Health and Insurance (Au Pairs)

Au pairs must organise and maintain appropriate health, accident, travel, and liability insurance for the duration of their placement. Sol Au Pairs is not liable for medical, travel, or emergency expenses incurred by either party.

20. Host Family Obligations

Host families must provide a clean, safe, and private bedroom, full board (meals), fair weekly schedule, and compliance with local laws. Families should ensure appropriate insurance when au pairs are driving and adhere to agreed duty hours and rest time.

Sol Au Pairs reserves the right to stop working with families who fail to meet these expectations or who behave inappropriately toward their au pair.

21. Compatibility and Early Departure

While we aim to find the best possible match, not every placement will suit both parties. Sol Au Pairs cannot guarantee compatibility and is not liable for personality differences, cultural misunderstandings, or early departure. Any additional costs related to a breakdown in the placement (e.g. flights, temporary childcare) are the responsibility of the family.
